Essential Terms & Conditions governing the Nudra for Oud experience in the State of Qatar, where rare oud oils and distinguished fragrances are offered.
These Terms & Conditions constitute a binding set of rules governing all purchases made from the Nudra for Oud online store. They form a legally enforceable agreement regulating the use of the website and the execution of purchase transactions.
الشروط والأحكام هي مجموعة من القواعد التي يجب على العملاء اتباعها عند الشراء من متجر ندرة للعود. تُشكّل هذه الشروط والأحكام اتفاقًا قانونيًا ملزمًا يحكم استخدام الموقع الإلكتروني وإجراء عمليات الشراء من متجر ندرة للعود. وبقيام العميل باستخدام الموقع أو إتمام أي طلب شراء، فإنه يُقر إقرارًا صريحًا بأنه قد اطّلع على هذه الشروط وفهم مضمونها ووافق عليها التزامًا وتنفيذًا، ويُعد هذا القبول موافقة قانونية مكتملة الأركان، لا يجوز الرجوع عنها أو التحلل منها بعد إتمام الطلب.
1) التعريفات
يقصد بالمصطلحات التالية المعاني الموضحة قرين كل منها:
Store / Company: Nudra for Oud.
العميل: أي شخص يزور الموقع أو يشتري منه.
Products: Amber, Blossom, Makhloot, Misk, Oud, Roses, Zabad and any other rare fragrance collectibles.
المنتجات عالية القيمة هي المنتجات التي تتجاوز قيمة مالية معينة أو التي تُصنّف بطبيعتها كنوادر نادرة أو منتجات عالية
المخاطر من حيث الاسترجاع، ويتم الإفصاح عن هذا التصنيف بشكل واضح وصريح قبل إتمام عملية الشراء، سواء على صفحة المنتج أو أثناء إجراءات الدفع أو في رسالة تأكيد الطلب، ويُعد ذلك قرينة قاطعة على علم العميل بهذا التصنيف وقبوله له.
البيع النهائي: يشير إلى المنتجات التي يتم تصنيفها صراحة على أنها بيع نهائي وغير قابلة للإرجاع أو الاستبدال الاختياري، ويكون هذا التصنيف ظاهرًا بوضوح قبل إتمام عملية الشراء، ويُعد إتمام الطلب بمثابة قبول نهائي من العميل لهذا التصنيف، وذلك دون إخلال بحقوقه القانونية في حالات العيب أو عدم المطابقة أو الخطأ في التسليم وفقًا للقوانين الآمرة.
Final Sale:
Products expressly designated as Final Sale and therefore not eligible for discretionary return or exchange. This designation is clearly displayed prior to purchase, and order completion shall constitute the Customer’s definitive acceptance thereof—without prejudice to their statutory rights in cases of defect, non-conformity, or delivery error under mandatory laws.
2) Scope of Application & Binding Effect
These Terms apply to the use of the website and to all orders placed through it within the State of Qatar.
The Customer’s use of the website or completion of an order after affirmatively selecting the acceptance checkbox constitutes a final legal acknowledgment of having read, understood, and accepted these Terms, resulting in full and unconditional compliance without reservation.
The Returns & Exchanges Policy, Quality Policy, and Product Classification Annex form integral and inseparable parts of these Terms.
Qatari e-commerce guidelines recommend that contractual documents (identification, website use, terms, privacy, etc.) be presented separately via clear links, with explicit acceptance obtained through a checkbox prior to order submission.

4) Order Creation & Confirmation
The display of products on the website constitutes an invitation to contract, and no final sale is concluded until the Company formally accepts the order and confirms its feasibility.
Automated confirmations or system notifications shall not constitute a binding acceptance unless product availability and order data have been duly verified.
Should fulfillment become impossible for any legitimate reason, the Company’s obligation shall be limited solely to refunding the amount paid, without any further liability or compensation.
The Company reserves the absolute right to reject, suspend, or cancel any order in cases of suspected fraud, inaccurate information, or payment disputes. In such cases, any refund issued shall represent the maximum extent of the Company’s liability, without additional compensation.
5) Pricing & Product Characteristics
The applicable prices are those displayed at checkout. The Company reserves the right to correct any technical or clerical pricing errors, in which case it may cancel the order and refund the paid amount without further obligation.
The Customer acknowledges that natural and rare products may exhibit inherent variations in color, density, aroma, or natural sediment. Such characteristics do not constitute grounds for warranty, return, or exchange unless they materially affect the declared essential specifications or render the product unfit for its intended purpose.
6) Payment
The Company offers multiple electronic payment methods, including local cards and Visa, and may add or remove payment options at its discretion without prior notice.
All payment transactions are subject to the security and verification procedures imposed by the payment service provider or relevant banking institution. The Company bears no responsibility for declined, suspended, or delayed payments caused by such entities.
The Customer is responsible for the accuracy and completeness of payment information provided. The Company shall not be liable for losses or delays resulting from incorrect payment data.
Where a refund is due, it shall be processed to the original payment method whenever feasible, and this shall constitute the full and final extent of the Company’s liability.
7) Complimentary Delivery within Qatar
Orders are delivered free of charge within the State of Qatar in accordance with the delivery zones and timeframes displayed on the website. The Company reserves the right to amend delivery schedules due to operational or force majeure circumstances.
An order shall be deemed delivered, and the Company’s responsibility shall cease, upon physical handover to the Customer or their authorized representative, or upon completion of approved delivery verification measures such as OTP or signature—particularly for High-Value Products.
The Customer is responsible for providing accurate delivery details and valid contact information. The Company bears no liability for delays or delivery failure caused by incorrect data and reserves the right to cancel the order without further obligation.
8) High-Value Products — Protective Measures
The Company reserves the right to apply enhanced security measures to High-Value Products, including—but not limited to—multiple security seals, unique serial numbers, pre-shipment condition documentation, recipient identity verification, and delivery authentication codes.
The integrity of seals, packaging, and serial numbers upon delivery constitutes legal evidence of conformity and absence of apparent defects.
Any tampering with seals, serial numbers, or packaging shall immediately void any discretionary return or exchange right. In such cases, any inspection conducted by the Company shall be limited solely to verifying the existence of a material defect or non-conformity, without further obligation.
9) Limitation of Liability & Safe Use
The Customer acknowledges that fragrance products may react differently from one individual to another. The Company recommends conducting a patch test prior to use and disclaims liability for effects resulting from failure to observe this recommendation.
The Company bears responsibility for product integrity until delivery in accordance with these Terms. Thereafter, responsibility for use, storage, or handling transfers to the Customer. The Company shall not be liable for misuse, improper storage, or subjective dissatisfaction, without prejudice to statutory consumer rights where a defect or non-conformity is proven.
10) Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws in force in the State of Qatar.
In the event that any provision conflicts with a mandatory consumer-protection rule, such mandatory rule shall prevail to the extent of the conflict only, while all remaining provisions shall remain valid and enforceable.
Any disputes or complaints shall be resolved amicably where possible; failing which, the Customer retains the right to refer the matter to the competent authorities within the State of Qatar.
